    Even when we agree on an IA, my client has to sign Form 12257, and I can’t see anyway around it. What is the position of others?

    Yes Brett – the IRS does not want to go through the trouble f setting up the IA if you plan to challenge it and file in Tax Court. This is normal procedure, and if you and the client are happy with the IA then I would sign it and send it back. We do it all the time.

    We want to ask for audit reconsideration and I have ordered a FOIA request. We are obtaining an Installment Agreement.

    By signing a Form 12257 Waiver will that bar us from asking for a reconsideration and any action based on the FOIA information??

    We are within 2 years of major payments so there is some money still on the table.
